child custody procedure for my daughter and her child

Machine translation.

Hello,
I am taking the liberty of asking a question on behalf of my daughter, who is being harassed by social services following the departure of her ex-partner with their two sons, of whom she has had no news for over a year. She has a 22-month-old daughter, and a social worker is trying to have her placed in foster care because she has been depressed (who would not be, without any news of their children)—a personal vendetta against which we are fighting.

She is appearing before the juvenile judge on June 20; it would be the end of everything for her if, on top of that, they take her little one away from her.
my question Will she keep her daughter with her? (and who knows how to find his sons)
Vanessa was born on September 29, 1978.
I know the date is quite close.
Thank you for the attention you will pay
Sincerely, Dorianat

Hello,

I don't know the family context, but in any case, for social services, if they have no evidence of abuse toward this baby, they cannot remove a child. And since your daughter will be appearing before the juvenile judge, she can request that her baby be examined by a medical expert to demonstrate that she is perfectly capable of caring for him. The fact that she is depressed does not preclude this. Your daughter will have to clearly express her anxieties regarding her sons to the judge and explain that, despite her depression, she is capable of caring for her baby. Also, in any case, any attestations from her neighbors or family would be admissible to show that she is an attentive mother.
There will be a lot of procedures, but a positive side is on the horizon. As for seeing her two sons, she will need to take steps with the family court judge and assert her rights as a mother, but this will require many more months of waiting...
Keep me posted, I remain at your disposal for any further information. In any case, there will be good news.
Have a good weekend

Hello,
Thank you for your quick reply.
My daughter has already seen the juvenile judge who ordered an investigation. The father of my daughter was present at the judge's office and at the investigation. Personally, I was not summoned to the investigation. The father of the little girl, who left in September, has not shown up since, neither at the investigation nor otherwise.
She explained the cause of her depression: her sons leaving, a first complaint to the family court, and then her father moving again with the children, followed by on-and-off disappearances.
The PMI and social services complained that the child was not attending daycare (the mother was not working and was on leave, and there were no spots at the daycare drop-in center), and the father, who was practically homeless, was in charge of the child; she has sorted all of this out.
As soon as the procedure for the little one is completed, we will initiate the procedure at the JAF at the last known address.
For a month now, I’ve been staying with her, looking after the little one during the day since she went back to work. I’m feeling really down, and the little one will have a spot in the daycare at my daughter’s workplace on Monday the 18th.
Critics point out that the little girl doesn't speak (she didn't know the investigator for 16 months), and the public health nurse was surprised by her shyness but did not consider conducting an ENT examination to check her hearing, which we have just done. Everything is fine on that front, and we will provide this to the judge, but a child does not walk, teethe, and speak all at the same time.
People criticize my daughter for being thin, even skinny, due to a lack of food. This is false; it is a morphological trait in our family, which we will demonstrate with photos showing the slender build. She ended up with an intern who conducted her assessment based on my daughter’s case: a mother who no longer hears from her sons and is in a state of moral decline. A confrontation resulted in a formal report being filed against her.
The judge who will see her on the 20th is a different judge who will take up the case; we hope she will understand the situation, and her father and I will be present.
She goes back to work, has a social life, a daycare, and a perfect health record for the child; the doctors don’t understand why.
Is it possible to explain the situation more clearly in a private message without being pushy, and how to proceed?
Once again, all my thanks and a wonderful weekend.

Hello Marylena

A quick note upon my return from vacation to let you know that my daughter has not yet received the judge’s ruling, which was due on July 5. We are hoping it is a good sign.
Sincerely

 Hello,
The court's decision: the child will remain with her mother, contrary to the social workers' request. There are no grounds, but a one-year educational support measure (AEMO) has been ordered to assist the mother.
So good news
Thank you, Marylena

Hello,

I am happy for you all for these good news, keep it up

Marylena

Yes, that’s one less problem. She will now initiate legal proceedings to regain custody of her sons. It’s not over with the courts yet.

Once again, all my thanks.
